Last year, the DBS (Disclosure & Barring Service) launched new guidance on DBS checks for EU citizens. Importantly, they clarified that a check does not give an overseas individual the right to be employed in the UK. An altogether separate check is required to gain permission to work in the UK. This is the case for both paid and voluntary positions.
What is the Application Process for DBS Checks for EU Nationals?
Employers can apply for DBS checks for European citizens once they have moved to the UK. It is not possible to run a background check for those living abroad, as the Disclosure and Barring Service are unable to access overseas records. The level of check required for EU citizens will depend on the role they are taking on.Â
If just a basic DBS check is required, EU nationals can apply themselves using the same online process as UK citizens (once they have moved to the UK). If a role involves working with children or other vulnerable groups, a standard or enhanced DBS check will be required. These two levels can only be applied for by employers.
Is This All I Need to Present to My Employer?
Some UK employers may also ask EU applicants for a police check from their home country, translated into English. You may also need to provide this if you are a UK citizen who has lived abroad for 6+ months at any point over the last 5 years.
How Can a DBS Check be Processed for an EU National Still Living Overseas?
As mentioned, DBS checks cannot be processed for EU citizens still living in their home country. If you’re an employer hoping to perform a background check on an overseas applicant, you will need to ask them to send you a police check from their home country. Candidates may also be able to provide you with a certificate of good conduct and references from their past employers.
